WalkUps Terms of Use
Effective October 29, 2026These terms are an agreement between Clarum LLC ("we", "us") and the business
that signs up for WalkUps ("you", "the store"). By creating a store account or
using WalkUps, you agree to them on behalf of your business. If you don't agree,
don't use WalkUps.1. What WalkUps is
WalkUps is an iPad app that helps formal-wear and bridal shops check in walk-in
shoppers, run appointments, suggest dresses, and track results. It's meant for
business use by a store and its staff.2. Your account
• One account covers your store. Every iPad signed in to it, and everyone who
uses those iPads, acts on your behalf.
• Keep your password and admin PIN private, and change them if you think someone
else knows them. You're responsible for what happens under your account.
• Give us accurate information when you sign up, and keep it up to date.
• You must be at least 18 and able to agree to these terms for your business.3. Subscriptions, free trials and billing
• WalkUps is sold as a monthly or yearly auto-renewing subscription through
Apple's App Store. Prices are shown in the app before you buy.
• Apple handles all billing. Payment is charged to the Apple ID that buys the
subscription, which renews automatically unless you turn off auto-renew at least
24 hours before the end of the current period.
• You can manage or cancel the subscription in the iPad's Settings → [your name]
→ Subscriptions, or from Admin → Subscription in the app. Canceling stops the
next renewal; you keep access until the end of the period you've paid for.
• If a free trial is offered, it turns into a paid subscription when it ends
unless you cancel before then.
• Refunds are handled by Apple under its policies. We can't issue refunds for
App Store purchases.
• One subscription covers every iPad signed in to your store.
• Without an active subscription, your store becomes read-only: you can still
view and export your data, but you can't add new shoppers.
• We may change prices for future periods. Apple will tell you before a price
increase applies, as its rules require.
• Some stores may be given free access by agreement with us. We can end free
access with 30 days' notice.4. Your data and your shoppers
• Your store's data, including the information your shoppers enter, belongs to
you. You give us permission to store, process, and transfer it only as needed to
provide WalkUps to you, as described in our Privacy Policy:
https://walkups.clarum.app/privacy
• You're responsible for having the right to collect your shoppers' information
and for using it lawfully. That includes telling shoppers how you'll use it,
following email and text marketing laws (such as CAN-SPAM, TCPA, and state
privacy laws), and honoring requests to unsubscribe, correct, or delete
information.
• The email opt-in box must be checked by the shopper, never by staff. Only send
marketing to shoppers who opted in.
• Don't enter information about children under 13. When a shopper is a minor,
the form should be completed with their parent or guardian.
• If you connect a Google Sheet or add email addresses for the daily summary,
you're choosing to send your data there. What happens to it after that is up to
you.
• You can delete your store account, and its data, in Admin → Subscription →
Delete Store Account. Deleting your account doesn't cancel an App Store
subscription; cancel that separately.5. Dress suggestions and AI
WalkUps uses artificial intelligence to suggest dresses and write the daily
summary. Suggestions are based on the shopper's preferences and the product
information on your website. They can be wrong or out of date, for example about
stock, sizes, or prices. They're there to help your staff, not to replace their
judgment. Check anything important before relying on it.6. Acceptable use
Don't:
• use WalkUps for anything illegal, or to collect information people haven't
agreed to give;
• try to access another store's data, or to get around the PIN, sign-in, or
subscription;
• copy, resell, or rent WalkUps, or reverse engineer it except where the law
allows;
• interfere with or overload the service, or use automated tools to access it;
• upload anything that infringes someone else's rights, such as a logo you don't
have permission to use.
We may suspend or close accounts that break these rules.7. Our service
• We work to keep WalkUps available and secure, but we don't promise it will
always be available or free of errors. The app saves visits on the iPad when the
internet is down and sends them later, but we can't guarantee every save in
every situation.
• We may update WalkUps, change features, or stop offering features. If we stop
offering WalkUps altogether, we'll give at least 30 days' notice so you can
export your data.
• Google Sheets, Apple, and other third-party services have their own terms, and
we're not responsible for them.8. Ownership
WalkUps, including the app, its design, and the WalkUps name and logo, belongs
to Clarum LLC. We give you a limited, non-exclusive, non-transferable license to
use WalkUps for your store while your account is active and you follow these
terms. Your logo, store name, and data remain yours. If you send us feedback or
ideas, we may use them without owing you anything.9. Ending these terms
You can stop using WalkUps and delete your account at any time. We can suspend
or end your account if you seriously or repeatedly break these terms, or if the
law requires it. When your account ends, your right to use WalkUps ends, and we
delete your data as described in the Privacy Policy. Sections 4, 8, 10, 11, 12,
and 14 continue to apply after these terms end.10. Disclaimer
WalkUps is provided "as is" and "as available." To the extent the law allows, we
disclaim all warranties, express or implied, including warranties of
merchantability, fitness for a particular purpose, and non-infringement. We
don't promise any particular sales results.11. Limit of liability
To the extent the law allows, we won't be liable for any indirect, incidental,
special, consequential, or punitive damages, or for lost profits, revenue, data,
or business opportunities, even if we were told they were possible. Our total
liability for any claim relating to WalkUps is limited to the amount you paid
for WalkUps in the 12 months before the claim arose. Some places don't allow
these limits, so they may not fully apply to you.12. Indemnity
You'll defend and hold harmless Clarum LLC from claims, losses, and costs
(including reasonable legal fees) arising from your store's data, your use of
your shoppers' information, your marketing, or your breaking these terms.13. Changes to these terms
We may update these terms. We'll post the new version here and change the date
at the top. If the changes are significant, we'll tell you in the app or by
email before they take effect. If you keep using WalkUps after that, you accept
the new terms.14. Governing law
These terms are governed by the laws of the State of [STATE], without regard to
its conflict-of-laws rules. Any dispute will be handled in the state or federal
courts located in [STATE], and both of us agree to those courts.15. Apple App Store terms
These terms are between you and Clarum LLC, not Apple. Apple isn't responsible
for WalkUps or its content.
• Your license to use WalkUps is limited to Apple-branded devices you own or
control, as allowed by the App Store's Usage Rules.
• Apple has no obligation to provide maintenance or support for WalkUps.
• If WalkUps fails to meet a warranty that applies, you may notify Apple, and
Apple will refund the purchase price, if any. To the extent the law allows,
Apple has no other warranty obligation for WalkUps.
• Clarum LLC, not Apple, is responsible for any claims relating to WalkUps,
including product liability claims, claims that it fails to meet legal or
regulatory requirements, consumer protection or privacy claims, and claims that
it infringes someone's intellectual property.
• You confirm that you're not located in a country subject to a U.S. government
embargo or designated as a "terrorist supporting" country, and that you're not
on any U.S. government list of prohibited or restricted parties.
• When using WalkUps, you must follow the terms of any third-party services you
use, such as your internet provider.
• Apple and its subsidiaries are third-party beneficiaries of these terms. Once
you accept them, Apple has the right to enforce them against you.16. Everything else
These terms and the Privacy Policy are the whole agreement between us about
WalkUps. If any part of these terms can't be enforced, the rest still applies.
If we don't enforce a part right away, we haven't given up the right to enforce
it later. You can't transfer these terms without our written permission. We can
transfer them as part of a merger, acquisition, or sale of our business.
